The parties agree that the present terms and conditions of sale, available on the day of the purchase, exclusively govern their relationship. The language proposed for the conclusion of the contract between the parties is French or English.
In the absence of any such condition, it shall be deemed to be governed by the practices in force in the distance-selling sector whose companies are headquartered in France.
1- Purpose
The purpose of the present terms and conditions is to define the terms and conditions of sale between AB2B2C and the User, from the placing of orders to after-sales services, including payment and delivery.
2- Products
The Products governed by these Terms and Conditions, hereinafter referred to as "the Products", are those shown on the https://www.ab2b2c.com/ website. They are offered within the limits of available stocks and/or those mentioned as being restockable.
3- Ordering
The User may place an order from the online catalog.
Any order implies acceptance of the prices and descriptions of the products available for sale. The User has the possibility of modifying his or her basket before final validation, this last step formalizing the sales contract between AB2B2C and the User.
In certain cases, notably non-payment, incorrect address or other problem on the User's account, AB2B2C reserves the right to block the User's order until the problem is resolved.
Orders can be sent to AB2B2C by mail or by Internet directly to our sales department (info@ab2b2c.com).
We will ship all items on the order to the address provided by the customer, according to the lead times and product availability shown on the product sheet.
If a product is definitively unavailable, we will propose a product with identical or superior characteristics to the customer, who may accept or refuse this new item. In the event of a low-value remainder, we reserve the right to cancel the remainder and, if necessary, refund it (in the event of advance payment).
As we mainly sell obsolete products, it may happen that the delivery date of a product is delayed (the customer will then be informed and will confirm his agreement or cancellation).
It may also happen that an order is cancelled, particularly if there is only one source of supply, and the product is not found in stock or is deemed non-compliant by our reception department.
Of course, we do our utmost to ensure that this happens very rarely, but in such cases no compensation or indemnity can be claimed.
Orders involving split or staggered deliveries to meet customer demand or concerning products not referenced by AB2B2C (non-catalog products) are considered firm. They cannot be totally or partially cancelled. For these orders, a deposit or even prepayment may be required.
4- Delivery
Packages can be shipped worldwide. The user should refer to the "Delivery" section of the https://www.ab2b2c.com/ website for details of shipping methods and costs.
Shipping costs are calculated on a flat-rate basis depending on the carrier. If this amount is exceeded, a surcharge will be applied to the shipping costs, which will be communicated at the time the order is placed.
Our delivery times are from the date of order acknowledgement. Delivery times are given for information only and are not guaranteed. Exceeding delivery times may not lead to cancellation of the order or compensation.
AB2B2C is authorized to make global or partial deliveries within the limits of availability, while respecting the amount of transport agreed upon at the time of order. In any event, compliance with delivery deadlines is subject to the buyer being up to date with all of its obligations to AB2B2C, regardless of the cause. A buyer partially delivered, particularly in the case of limited stock, may not claim any compensation.
Goods travel at the risk of the customer, who takes delivery of them under his own responsibility, whatever the mode of transport or method of payment. It is the customer's responsibility to check the quantity, quality, weight and dimensions of the goods delivered upon receipt and, in the event of damage, to exercise any recourse against the carrier. In the event of direct delivery by AB2B2C, the customer must report any damage or defects to the delivery person.
5- Payment
The User has several means of payment:
Online with the order by credit card: Carte Bleue, Visa, Mastercard. The User's account will be debited when the order is placed. In the case of out-of-stock or unavailable products, reimbursement will be made as soon as the supply problem is known. Credit card transactions are carried out using the CREDIT MUTUEL secure payment system. This procedure is designed to protect you against fraud.
Online with Paypal order:
The User's Paypal account is debited as soon as the order is placed. In the event of Products being sold out, a refund will be made directly to the User's Paypal account.
By bank transfer: Available items are dispatched once the transfer has been received.
Bank account: CREDIT MUTUEL DE BRETAGNE VANNES. In the event of products being sold out or unavailable, a refund will be made by transfert.
Orders for products not in stock or out of catalog are payable when the order is placed, unless otherwise agreed in writing.
AB2B2C reserves the right to make partial deliveries accompanied by a separate invoice. Any partial delivery must be considered as a separate contract. Consequently, the customer may not take advantage of the fact that the balance of the equipment ordered is still outstanding to pay for the goods delivered.
However, AB2B2C will not be able to invoice more transport costs than indicated on the order.
6- Prices
Prices are indicated in €uros excluding taxes.
These prices do not include a flat-rate contribution to processing costs (postage, packaging and preparation of the parcel according to the amounts in force).
If one or more taxes or contributions, in particular environmental taxes, were to be created or modified, either upwards or downwards, this change could be passed on to the sales price of the articles present on the AB2B2C site and sales documents.
The user will also have to pay a fixed sum corresponding to a contribution to the costs of processing and shipping the order (unless he/she benefits from a special offer exempting him/her), the amount of which will be specified on the order form before validation of the latter. This contribution may depend on the products ordered.
In the event of the display of an erroneous price, obviously derisory (low price), for whatever reason (computer bug, manual error, technical error, fraudulent use of the voucher system), the User's order, even if it has already been validated by AB2B2C, will be cancelled, of which AB2B2C will inform the User as soon as possible. The User, if it so wishes, will then have the possibility of placing its order again at the corrected and exact price.
7- Right of withdrawal and returns
The User has a right of withdrawal of fourteen (14) calendar days from the date of receipt or collection of the parcel.
When the User's right of withdrawal expires on a weekend, public holiday or day off, it is extended until the next working day.
To exercise its right of withdrawal, the User must notify AB2B2C's customer service department (info@ab2b2c.com - 04.22.16.62.94) of its decision to withdraw from this contract by means of an unambiguous statement: by mail sent by post, by email by logging into its customer area and going to the "contact us" section.
If the User uses this option, AB2B2C will immediately send him/her an e-mail acknowledging receipt of his/her retraction.
All Products can be reimbursed except those excluded, as they have been customized at the User's request (notably paired tubes, etc.).
The User must ensure that the order for which he/she is retracting is returned complete. Products to be returned must be intact and complete. Items returned incomplete, spoiled or damaged will not be accepted.
The User must send or return the good to AB2B2C at the address below, without excessive delay and, in any event, no later than fourteen days after having communicated to AB2B2C its decision to withdraw from this contract. This period is deemed to have been respected if the User returns the goods before the fourteen day period has expired.

The User can return his Product to AB2B2C by La Poste without having to justify the reason.
Within the framework of exercising the right of retraction, the cost of return is the responsibility of the User (with the exception of a defective Product upon receipt, or an error when sending the Product).
Effects of withdrawal
In the event that the User withdraws from this contract, AB2B2C will reimburse all payments received from the User, including delivery costs, without undue delay and, in any event, no later than fourteen days from the day on which AB2B2C is informed of the User's decision to withdraw from this contract.
AB2B2C may defer reimbursement until receipt of the good or until receipt of proof of shipment of the good (Copy of the Colissimo slip) from the User, the date used being that of the first of these facts.
AB2B2C will reimburse the User for the Products returned and the shipping costs initially paid, subject to compliance with the above-mentioned return conditions.
The User will be reimbursed by the same means of payment used to pay for the returned order. This refund will not incur any costs for the User.
8- Warranties
Commercial warranties
Electronic components are guaranteed for 1 year, with the exception of electronic tubes, which are only guaranteed for 3 months.
Legal warranties
The manufacturer's commercial warranty or AB2B2C's commercial warranty do not preclude the benefit of the legal warranty against hidden defects in the products sold and the legal warranty against defects in conformity of the goods with the contract.
Legal warranty of conformity (see reference texts below):
When the User acts under the legal warranty of conformity :
He/she has a period of 2 years from delivery of the goods to take action (Article L211-12 of the French Consumer Code).
He may choose between repair or replacement of the good, subject to certain cost conditions stipulated in Article L.211-9 of the French Consumer Code.
He is exempted from proving the existence of a lack of conformity during the six months following delivery of the goods (Article L211-7 of the French Consumer Code). This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.
The legal warranty of conformity applies independently of any commercial warranty or manufacturer's warranty.
Legal warranty against hidden defects on products sold (see reference texts below):
The User may decide to invoke the legal warranty against hidden defects in the item sold, as provided for in article 1641 of the French Civil Code. In this case, he/she may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.
Article L211-4 of the French Consumer Code:
The seller is required to deliver goods in conformity with the contract and is liable for any defects in conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation, when the latter is his responsibility under the contract or was carried out under his responsibility.
Article L211-5 of the French Consumer Code:
To conform to the contract, the goods must :
Be fit for the purpose ordinarily expected of similar goods and, where applicable : - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
- have the qualities that a purchaser may legitimately expect, having regard to public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
Or present the characteristics defined by mutual agreement between the parties, or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.
Article L211-7 of the French Consumer Code:
Defects in conformity which appear within six months of delivery of the goods are presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is not compatible with the nature of the good or the alleged lack of conformity.
Article L211-9 of the French Consumer Code:
In the event of a lack of conformity, the buyer may choose between repair and replacement. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the good or the importance of the defect. He is then obliged to proceed, unless this is impossible, according to the method not chosen by the buyer.
Article L211-12 of the French Consumer Code:
Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.
Article L211-16 of the French Consumer Code:
When the buyer asks the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the warranty, any period of immobilization of at least seven days is added to the remaining warranty period. This period runs from the date of the buyer's request for intervention, or from the date the item in question is made available for repair, if the item is made available after the request for intervention.
Article 1641 of the French Civil Code:
The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.
Article 1648 of the French Civil Code:
The action resulting from redhibitory defects must be brought by the purchaser within two years of discovery of the defect. In the case provided for in article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be discharged of the apparent defects or lack of conformity.
Except in the case of a legal warranty, any transaction resulting from a lack of conformity between AB2B2C and the User, which is not contested within 24 months, cannot give rise to a claim.
AB2B2C's After-Sales Service will either return your product to the supplier (within approximately 4 weeks), or exchange your product.
NB: In all cases, the warranty applies only to the parts sold, and all other actions or warranty claims are excluded, in particular the repair of direct or indirect damage caused to persons or objects other than the products delivered, as well as the assumption of responsibility for any loss of profit. The warranty does not entail any reimbursement by AB2B2C of any labor costs incurred by the User.

10- Intellectual property

12- Duration
These terms and conditions apply for the duration of the online services offered by AB2B2C.
Proof, conservation and archiving of transactions
The computerized registers, kept in the computer systems of AB2B2C and its partners under reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.
Applicable law and jurisdiction
These terms and conditions are governed by French law. The competent court in the event of litigation will be that of VANNES. This site complies with French legislation, and in no case does AB2B2C guarantee compliance with local legislation that may be applicable to you, when you access the site from other countries.
13- Late and non-payment
In the event that the customer defaults on the payment of any sum due to AB2B2C, we reserve the right, with or without prior notice, to suspend all deliveries to the customer until the customer has paid the sum or sums due.
In the event of late payment, penalties will be calculated on the basis of 3 times the legal interest rate.
A fixed legal indemnity of €40 for collection costs will be applied in addition to late payment penalties.
